Acceptance of Terms

These Terms of Service ("Terms") form an agreement between you and MoonAI LLC, the operator of H3Max, and govern your access to and use of the Service. By creating an account, purchasing a paid feature, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

H3Max is an independent AI-assisted media creation platform operated by MoonAI LLC. The Service provides video, image, music, and voice generation through supported third-party models, together with related account, Credit, subscription, and billing features. Available models, features, output characteristics, processing times, Credit costs, and usage limits may change as the Service evolves.

You must be legally able to enter into these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.

Accounts and Security

You must provide accurate information and keep your account credentials secure. You are responsible for activity performed through your account. Notify us promptly if you believe your account has been compromised. You may not sell, transfer, or share access in a way that creates security or abuse risks.

User Content

You retain the rights you hold in prompts, uploads, and generated outputs. You grant us and our service providers a limited, non-exclusive license to host, process, transmit, and display that content only as necessary to provide, operate, and secure the service.

You represent that you have the rights and permissions required to submit your content. You are responsible for reviewing generated outputs before using or publishing them. AI outputs may be inaccurate, unexpected, or similar to content produced for others, and we do not guarantee that an output is unique or eligible for intellectual-property protection.

Acceptable Use

You may not use the Service to:

• Break the law or infringe privacy, publicity, copyright, trademark, or other rights.
• Create or distribute unlawful, fraudulent, deceptive, abusive, exploitative, or harmful content.
• Upload malware, attempt unauthorized access, interfere with the service, or bypass usage or security controls.
• Scrape, reverse engineer, resell, or automate access except where expressly permitted.
• Misrepresent AI-generated content in a way that violates applicable law or causes harm.

We may remove content or limit access when reasonably necessary to enforce these Terms or protect the service and its users.

Payments, Credits, and Subscriptions

Prices, included credits, billing periods, and applicable taxes are shown before checkout. Paid features may include one-time credit purchases and automatically renewing subscriptions.

• Subscription fees are charged at the beginning of each billing period until cancelled.
• You may cancel a subscription before its next renewal; access and included benefits may continue through the paid period.
• Credits may be subject to expiration, usage limits, and plan-specific rules shown at purchase.
• You are responsible for providing accurate billing information and any applicable taxes.

Refunds and billing corrections are governed by our Refund Policy.

Third-Party Services

The Service may rely on third-party authentication, payment, hosting, storage, analytics, and AI processing. Their availability may affect the Service, and your use of an integration may also be subject to that provider's terms.

Suspension and Termination

We may suspend or terminate access if you violate these Terms, create risk or harm, fail to pay amounts due, or if required by law. You may stop using the service at any time. Sections that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, and liability limitations—will survive.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted operation, error-free outputs, specific generation results, or that generated content will be suitable for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from use of the Service.

Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

Changes to These Terms

We may update these Terms as the service or legal requirements change. Material changes will be communicated through the service or by updating this page. Continued use after the effective date means you accept the revised Terms.
